Professional Negligence
At some point we all require the services of lawyers, medical practitioners, engineers and other professionals. When providing a service, professionals are under a duty to exercise the care, skill and diligence of a reasonably skilled professional in their particular field.
If you have suffered injury or loss as a result of the negligent provision of legal, medical or other professional advice, or negligent diagnosis or treatment, you may have a claim for compensation where:
- it is established that the professional fell below the standard of reasonable care expected of a professional in his/her position; and
- the negligent advice, treatment or diagnosis caused the injury or damage.
Where the professional is found liable you will be entitled to compensation that will restore you to the position (as much as possible) you would have been in but for the negligence. Compensation may include:
- past and future loss of earnings;
- past and future medical expenses;
- past and future pharmaceutical expenses;
- past and future services; and
- general damages.
General damages include compensation for losses such as pain and suffering, loss of amenities, loss of expectation of life and disfigurement.
At Bradley Bayly Legal, our professional negligence lawyers believe every professional should be held accountable and will examine your case carefully to see if you have a claim.
